I, understand that I am responsible for loss of and/or damage to any and all equipment loaned or rented to me by
Challenge Diving and that it is my obligation to return this equipment only to the location from which I received it.
I am aware of the inherent hazards of scuba diving and agree that I must:
- Be in good mental and physical condition for diving and avoid being under the influence of alcohol or drugs while diving. I understand that if I am
under the influence of alcohol or drugs, I will be disqualified from diving and all monies paid for dives for which I am disqualified will not be refunded.
- Engage only in diving activities consistent with my training and experience.
- Listen carefully to dive briefings and respect the advice of the Divemasters supervising my diving activities.
- Adhere to the buddy system throughout every dive.
- Observe local diving laws which state specifically that nothing may be removed from the reefs within park boundaries.
- Never exceed depth or time limitations planned by my Divemasters.
- Maintain proper buoyancy control when diving and do my best to avoid causing damage to the fragile reef ecology.
I, , affirm that I am a certified diver. I feel confident and ready to dive. I understand the hazards of
scuba diving including those hazards occurring during boat travel to and from the dive site. I understand that these hazards include, but are not limited
to, air expansion injuries, drowning, decompression sickness, slipping or falling while on board, being cut or struck by a boat while in the water, injuries
occurring while getting on or off a boat, and other perils of the sea. By signing this release, I certify that I am of lawful age and legally competent to sign
this liability release. I do hereby exempt and release Challenge Diving, its agents, contractors,
employees or assigns (the “Released Parties”) from all liability and responsibility for personal injury, property damage or wrongful death, however
caused, including, but not limited to product liability or the negligence of the Released Parties, whether passive or active. I acknowledge that I have read
the foregoing paragraphs, fully understand the potential dangers incidental to engaging in travel to the dive sites by boat and the scuba dive(s). I am
fully aware of the legal consequences of signing this instrument, and that I understand and agree that this document is legally binding and will preclude
me or my heirs from recovering monetary damages from the Released Parties whether specifically named or not, for the personal injury, property
loss/damage or wrongful death caused by product liability or the negligence of the Released Partners, whether passive or active. I am fully ware of and
expressly assume these and all other risks involved in travel to or from a dive site by boat and by making such a dive or dives. I have read and do fully
understand all of the above stated information. I understand and agree that I am not only giving up my right to sue the Released Parties but also any
rights of my heirs and/or assigns to sue the Released Parties. It is my intention to exempt and release Cahllenge Diving and it's
agents from all liability whatsoever for personal injury, property loss/damage, or wrongful death.
